The dispute arose from a cross-border contractual relationship involving margin financing and securities trading. The arbitration was conducted under the HKIAC Administered Arbitration Rules (2018), with Hong Kong law as the governing law and English as the language of the proceedings. The arbitration was handled directly by Haiwen’s Hong Kong office without the engagement of external counsel, underscoring the firm’s in-house capability and expertise in managing complex cross-border disputes.

The Tribunal has recently issued a final award in favour of the client, granting substantially all of the relief sought, including recovery of the outstanding amount, contractual interest, and legal costs on an indemnity basis. The Tribunal also confirmed the client’s entitlement to recover the full costs of the arbitration, in line with the applicable rules and contractual provisions.

Shortly after the commencement of the arbitration, Haiwen’s Shanghai team successfully obtained an asset preservation order from a Mainland Chinese court to detain and freeze the respondent’s bank accounts as well as stocks of a listed company. The preservation order was secured under the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and the Hong Kong Special Administrative Region, making it one of the increasingly important tools for safeguarding creditor rights in cross-border arbitration.
