Successfully held on 23 March 2026, the high-level event brought together over 120 representatives from leading law firms, enterprises, and arbitration institutions from both cities, in a concerted effort to deepen Hong Kong–Shanghai legal cooperation and explore how Hong Kong’s unique legal system can support China’s 15th Five-Year Plan” and high-level opening-up initiatives.
在題為《以香港法律管理風險的實務分享——從法治強優勢到合作新機遇》的演講中，劉洋律師結合豐富的國際商事法律實務經驗，闡述了香港法律在復雜多變的全球監管環境中，為企業提供制度化確定性與穩定性的核心優勢。他指出：“在‘一國兩制’下，香港的雙重法律結構使其成為連接中國內地大陸法體系與國際普通法體系的獨特‘制度轉換器’。結合香港完善的法治框架與內地穩健的監管體系，企業可以構建跨法域、全周期的風控架構，從而提升全球競爭力。”
During his presentation titled “Managing Business Risks under Hong Kong Law – From the Rule-of-Law Advantage to New Avenues of Cooperation”, Mr. Liu shared practical perspectives on how Hong Kong law acts as a stabilising force for cross-border enterprises, providing certainty and institutional predictability in an increasingly complex global regulatory environment. “Hong Kong’s dual legal structure under ‘One Country, Two Systems’ allows it to act as a unique ‘institutional converter’ between the Mainland’s civil law system and the international common law order,” said Mr. Liu. “By combining the strengths of Hong Kong’s rule-of-law framework and the Mainland’s robust regulatory system, enterprises can establish comprehensive, multi-jurisdictional risk management structures and enhance their global competitiveness.”
在演講中，劉律師通過實際案例分享了如何運用香港法律的契約可預期性與仲裁制度的高效性，在跨境交易中有效防控風險。他舉例說明，企業可通過設定“法律變更條款”及“不可抗力條款”，在爭議發生前實現風險分擔；并可借助內地與香港簽署的仲裁程序中臨時措施安排，在仲裁程序中獲得內地法院財產保全支持。該安排在全球范圍內獨具特色，使香港在國際仲裁領域脫穎而出。
Mr. Liu also illustrated through real-world examples how contractual predictability and cross-border arbitration efficiencies under Hong Kong’s legal system can help Mainland enterprises manage international transactions more effectively. These include using change-in-law and force-majeure provisions to allocate risks fairly and leveraging the Interim Measures Arrangement between Hong Kong and the Mainland to secure interim relief in arbitration, which is an arrangement distinguishing Hong Kong from other arbitration venues.
在談到內地與香港之間“五項司法協作安排”時，劉律師指出，這些覆蓋仲裁裁決互認與執行、仲裁保全協助、民商事判決互認、婚姻家事判決互認及跨境破產協助的制度安排，共同構成了企業風控的“司法協作矩陣”，也是滬港法律合作的重要制度基石。“法律不僅用于事后救濟，更應成為事前預防之盾，”劉洋律師表示，“香港法律將法治的穩定性轉化為企業的確定性優勢，而滬港律師的緊密合作，則把制度互補性化為企業國際化發展的推動力。”
Citing the collaborative framework of the five judicial cooperation arrangements, ranging from mutual enforcement of judgments to insolvency cooperation, Mr. Liu highlighted how these mechanisms form a “judicial cooperation matrix for risk management” and provide a strong foundation for Shanghai–Hong Kong legal synergy. “Law is not merely for dispute resolution after the fact, but for risk prevention in advance,” Mr. Liu added. “Hong Kong law turns legal certainty into a business advantage, while Hong Kong–Mainland lawyer collaboration transforms complementarity into a driver of enterprises’ international success.”
