The Practice Note provides a comprehensive overview of the key issues manufacturers, importers, distributors and retailers must be aware of when introducing a new product into China, developing a product safety compliance programme, and facing a product safety hazard situation.
The Practice Note first outlines the key legislation for consumer and industry-specific products (such as automobiles, food, pharmaceuticals, and medical devices, etc.) and the regulatory authorities responsible for supervising it.
The authors then discuss express and implied terms in a purchase and sale contract, product packaging and labelling requirements, situations that give rise to disclosure obligations, and corrective actions. In addition, the Practice Note also covers importers’ obligations in relation to foreign-manufactured products. Furthermore, the enforcement of product safety in China including criminal and administrative sanctions and liability in contract and tort are examined.
The Practice Note concludes by highlighting recent legislative developments in China’s product regulation and safety legislation, including the Measures for the Administration of Food Safety Standards 2023 and the Implementation Regulations of the Law of the PRC on the Protection of Consumer Rights and Interests 2024. These regulations have far-reaching implications for strengthening product quality and safety supervision and protecting consumer rights and interests, and also provide the latest legal guidance for enterprises to operate in compliance.
