Recently, the prestigious legal rating firm Chambers and Partners (“Chambers”) has once again invited Haiwen’s Entertainment Law Practice Group to author an article for its Expert Focus (“Expert Focus”) publication.  The article, titled “Rules to Be Amended to Permit Sino-Foreign Co-Production of Web Series” , is co-authored by partner Cao Yu and senior counsel Tang Danni.

The article offers a comprehensive overview of the highlights in the Administrative Regulations on Sino-Foreign Television Drama Co-Productions (Draft Amendment) released by the National Radio and Television Administration in March 2023.  The Draft Amendment now officially puts the co-production of web series under the same regulation as TV series.  Additionally, it expands the official co-production channel to encompass various internet-based content forms, including web films, web micro-series, and web cartoon series.  It also relaxes the eligibility criteria for Chinese partners and allows for more flexibility in finance structuring and talent and crew engagement for co-productions.
The Draft Amendment has been introduced against the backdrop of the absence of a generally available Sino-foreign co-production channel for web series. In practice, stakeholders have adopted creative structures to make the co-production of web series possible.  However, there are tax concerns with respect to such approach and the potential regulatory risks cannot be entirely removed.  With the official co-production channel for web series opened, we can expect to see more foreign production funding come in with tax concerns and regulatory risks reduced.
