本次培訓(xùn)班由中華人民共和國(guó)司法部、香港特別行政區(qū)律政司及香港國(guó)際法律人才培訓(xùn)學(xué)院聯(lián)合主辦,匯聚了來(lái)自國(guó)有企業(yè)、民營(yíng)企業(yè)、仲裁機(jī)構(gòu)及高校的約四十名資深法律專業(yè)人士與企業(yè)法務(wù)負(fù)責(zé)人。培訓(xùn)旨在借鑒首期培訓(xùn)班的成功經(jīng)驗(yàn),進(jìn)一步提升內(nèi)地涉外仲裁與爭(zhēng)議解決人才處理復(fù)雜國(guó)際案件的專業(yè)能力。
The Training Course, co-organised by the Department of Justice of Hong Kong SAR, the Ministry of Justice of the People’s Republic of China, and the Hong Kong International Legal Talents Training Academy, brought together around 40 senior legal practitioners and in-house counsel from state-owned enterprises, private corporations, arbitration institutions, and academia across the Chinese Mainland. The programme aims to strengthen the professional capabilities of Mainland arbitration and dispute resolution talent in handling complex international cases, building on the success of its first edition in 2025.

在講座中,劉律師深入剖析了當(dāng)事人在跨境合同中如何有效起草和談判爭(zhēng)議解決條款,重點(diǎn)闡述了在仲裁與訴訟之間作出選擇的關(guān)鍵考量、確保仲裁條款清晰與可執(zhí)行的重要性,以及選擇香港作為中立且國(guó)際公認(rèn)仲裁地的戰(zhàn)略優(yōu)勢(shì)。劉律師結(jié)合商業(yè)實(shí)務(wù)及香港的最新判例,分享了關(guān)于調(diào)解—仲裁多層次機(jī)制的設(shè)計(jì)要點(diǎn)、“病理性條款”的常見(jiàn)風(fēng)險(xiǎn),以及“一帶一路”及對(duì)外投資項(xiàng)目中中國(guó)企業(yè)的談判策略。
Mr?Liu’s lecture provided a detailed and practical exploration of how parties can effectively draft and negotiate dispute resolution clauses in cross-border contracts, highlighting key considerations in choosing arbitration over litigation, the importance of clarity and enforceability in arbitration agreements, and the strategic advantages of selecting HongKong as a neutral, internationally recognised seat of arbitration. Drawing examples from commercial practice and recent Hong Kong cases, Mr?Liu shared insights on multi-tiered mechanisms (such as mediation–arbitration procedures), pitfalls in “pathological” clauses, and negotiation approaches for Chinese enterprises participating in Belt and Road or outbound investment projects.

In his remarks, Mr?Liu underscored HongKong’s role as a bridge between civil and common law systems: “As Hong Kong continues to enhance its position as an international arbitration hub under the ‘One Country, Two Systems’ framework, it offers Chinese enterprises a unique forum that combines neutrality, legal certainty, and enforceability across jurisdictions under the New York Convention.”

Mr?Liu’s participation followed an invitation from the Secretary for Justice, Mr?PaulLam SC, and formed part of a distinguished faculty that included leading practitioners, scholars, and arbitrators from Hong Kong, the Mainland, and international institutions such as the Permanent Court of Arbitration.

In addition to his professional commitments, Edward Liu has recently been appointed as an Adjunct Professor of Law at City University of HongKong, where he contributes to the development of legal education and arbitration research. Mr?Liu also serves on multiple advisory bodies to the HKSAR Government, including the Chief Executive’s Policy Unit Expert Group, the Hong Kong International Legal Talents Training Expert Committee, the Advisory Group on Legal and Dispute Resolution Services, Working Group on Arbitration Law Reform etc.
