On 26 ?March ?2026, Mr.?Liu spoke in a concurrent?session?concerning?charterparty?issues, delivering a presentation titled: “Navigating the Digital Wave: The Impact of Shipping Technology on Maritime Disputes and the Merits of Hong?Kong Maritime Arbitration.” He discussed how emerging technologies such as artificial intelligence, blockchain, electronic bills of lading, and vessel performance data are reshaping the evidentiary foundations of maritime disputes under English and Hong?Kong law, while reaffirming that technology transforms the proof, not the principles, of maritime law.
結合英國《電子貿易文件法案》及香港依據聯(lián)合國國際貿易法委員會《電子可轉讓記錄示范法》完善數字貿易立法的最新進展,劉律師闡述了亞洲地區(qū)電子貿易法律框架的趨同趨勢,并強調香港在海事仲裁領域的獨特優(yōu)勢,包括以《聯(lián)合國示范法》為藍本的現代仲裁制度、司法機關一貫的仲裁支持立場,以及與中國內地之間的仲裁保全安排。
Drawing on the UK?Electronic?Trade?Documents?Act 2023 and Hong?Kong’s alignment with international digital trade standards under UNCITRAL’s?MLETR, Mr.?Liu highlighted the growing convergence in electronic trade frameworks across Asia and Hong?Kong’s competitive advantages in maritime arbitration—its modern UNCITRAL?based ordinance, supportive judiciary, and unique arrangement with Mainland of China for interim measures.
他還分享了關于在香港新設立的國際調解院及“調解—仲裁”混合機制發(fā)展的前景,指出此類機制有助于提升爭議解決效率、維護商業(yè)合作關系。
He also discussed opportunities arising from the newly established International Organisation for Mediation (IOMed) in Hong Kong and the development of Med?Arb hybrid mechanisms, which enhance efficiency and preserve commercial relationships in maritime disputes.
